上海国际仲裁(香港)中心于2024年5月正式设立,成为上海仲裁界设立的首家内地以外分支机构。
目前内地仲裁机构在香港设立分支的已有4家,此前3家分别为中国国际经济贸易仲裁委员会、中国海事仲裁委员会、深圳国际仲裁院。
上海国际仲裁中心秘书长王唯骏说,香港长期以来是全球公认的最受欢迎的仲裁地,其在解决国际商事争议方面具有举足轻重的地位,上国仲希望能够依托香港这个国际舞台与世界进一步连接。
上国仲副主任马屹则表示,香港中心将依托香港与全球的联系,进一步用高质量、国际化的仲裁法律服务,助力国家对外开放战略、织密服务企业网、为国际贸易和投资发展提供法治保障。
上国仲成立于1988年,在过去35年来为国内外各类商事主体提供争议解决服务,其案件当事人遍及全国各地和世界上85个国家和地区。
目前,上国仲《仲裁员名册》中共有1463名仲裁员,来自80个国家和地区,外籍及港澳台地区仲裁员382名,占比达26.11%
自2003年香港律政司与上海市司法局签署法律服务合作协议书起,沪港两地在法律合作交流方面互动频繁,两地互派法律工作人员进行短期实习或接受培训课程。两地的律师事务所亦互相设立分支机构,促进两地法律服务的多元化发展。
SHIAC establishes presence in Hong Kong, becoming the fourth Mainland arbitration institution with a branch in the region
The Shanghai International Arbitration (Hong Kong) Centre was officially established in May 2024, marking the first overseas branch of Shanghai's arbitration community. It joins three other mainland arbitration institutions with branches in Hong Kong: the China International Economic and Trade Arbitration Commission (CIETAC), the China Maritime Arbitration Commission (CMAC), and the Shenzhen Court of International Arbitration (SCIA).
Wang Weijun, Secretary-General of SHIAC, emphasizes Hong Kong’s reputation as a globally recognized and highly preferred arbitration hub, playing a pivotal role in resolving international commercial disputes. SHIAC aims to leverage Hong Kong’s international platform to enhance its global connectivity.
Deputy Director Ma Yi notes that the Hong Kong centre will capitalize on the region's global links to provide high-quality, international arbitration services. These efforts align with China’s strategy for further opening up, strengthening business support networks, and offering legal protection for global trade and investment development.
Founded in 1988, SHIAC has provided dispute resolution services to various domestic and international commercial entities over the past 35 years, with parties from across China and 85 countries and regions worldwide.
Currently, SHIAC’s roster of arbitrators includes 1,463 professionals from 80 countries and regions, with 382 arbitrators from overseas and Hong Kong, Macau, and Taiwan, accounting for 26.11 percent of the total.
Since the Hong Kong Department of Justice and the Shanghai Municipal Bureau of Justice signed a legal services cooperation agreement in 2003, the two regions have maintained frequent exchanges in legal cooperation. Initiatives include mutual secondments of legal professionals for short-term internships or training programs, as well as law firms establishing branches in each other’s jurisdictions to promote the diversified development of legal services.
