China has launched a specialized bankruptcy court in the southern city of Shenzhen, which is expected to provide enhanced judicial support for its Greater Bay Area (GBA) initiative.
The Shenzhen Bankruptcy Court will function under the aegis of the Shenzhen Intermediate People’s Court, and it has jurisdiction over four types of cases, including cross-border bankruptcy cases. It can also trace the assets of bankrupt mainland businesses that have been transferred to Hong Kong.
The Shenzhen Intermediate People’s Court has a history of innovation when it comes to bankruptcy. In 1993, it set up the country’s first bankruptcy trial court to explore centralized jurisdiction and professional trials. In 2017, the Court initiated online auctions for the cross-border sale of bankrupt properties.
In the past years, the Shenzhen Intermediate People’s Court has handled a third of bankruptcy cases in Guangdong Province, and five percent of the total nationwide.
