OVERVIEW
On January 3, 2025, the government of India’s Ministry of Electronics and Information Technology unveiled the Draft Rules for the Digital Personal Data Protection Act. These Draft Rules operationalise various provisions and throw light on the compliance under the Digital Personal Data Protection Act 2023 (DPDPA), which is India’s first standalone data protection legislation.
The Draft Rules provide a detailed framework for implementing the provisions of the DPDPA. It addresses key aspects such as notice and consent requirements, how the State processes data, obligations of a Data Fiduciary, and cross-border data transfers. Once brought into force, it will govern the entire processing of personal data in digital form, and the compliance period for businesses begins.
This legislation is designed to strengthen data protection and accountability for entities such as internet companies, mobile apps, and businesses that handle citizens’ data. Furthermore, it is worth noting that the DPDPA will have implications for India’s trade negotiations with other nations. It aligns with global data protection standards, taking inspiration from models like the EU’s GDPR and China’s PIPL.
