今年,1944余位公司法务及商务人士参与ALB调研,评选出了他们心目中的20位首选律师。在“持续内卷”时代,客户对于律师的服务提出了哪些新的要求?他们希望律师具备怎样的特质?法律人又如何应对这些挑战? ALB与上榜者聊了聊赢得客户青睐的秘诀。 

 

全球经济疲软是不争的事实,在此背景下,法律服务市场的发展也略显乏力。需求增容有限,从业者数量却不断上升,这对法律人提出了更为严苛的要求,但也不断呼求律师革新思维,为客户提供更精湛、更有效率、更具性价比的专业服务。

汤森路透在《2024年企业法律部门状况》报告中发现,受基础业务需求驱动,企业法务不断通过将内部消化工作、和不同律所合作相结合,以实现效率提升。报告较为乐观地指出,未来,企业法务普遍预计会增加聘用外部法律顾问的费用。

今年参与ALB调研的1944位企业法务与商务人士从多元角度出发,对他们的法律顾问做出了客观中肯的评价。在调研当中,除精深的专业技能之外,客户还多次提及以下几方面能力的重要性:一、严谨、敬业的工作态度;二、良好的服务意识;三、懂得客户之所需。

因此,软硬技能兼备,成为了新时代对法律人提出的挑战。

双重要求

随着全球经济一体化的深入发展和国际贸易环境的日益复杂,律师们发现,客户对法律服务的需求发生了显著变化。

在竞天公诚律师事务所合伙人骆嘉昀律师看来,专业能力和服务精神始终是律师职业的两大核心,两者的结合对于提供卓越的法律服务至关重要。作为一位服务于资本市场领域的律所,他坦言,资本市场变化节奏快,客户期待律师不仅能够解读法律条文,而是提供全面的解决方案,且能够迅速、精准响应客户需求。

“专业能力是律师工作的基石。要不断追求专业知识的深度与广度,确保能够以精准和高效的方式解决客户的法律难题。其次,服务精神体现在对客户需求的深刻理解和对工作的深度投入。需要致力于倾听与理解,聆听客户需求,洞察他们的商业愿景和具体挑战。全身心投入到每个项目中,才能确保客户感受到专业和个性化的服务体验。”骆律师表示。

他进一步指出,这种双重性要求律师不仅具备扎实的法律知识,还要能够与客户建立信任,展现出对客户利益的深切关怀和坚定承诺。

作为跨境领域专家,中联律师事务所合伙人薛为华律师则提到,在跨境贸易、投资、合规等复杂多变的场景中,客户面临的问题往往涉及多个司法管辖区和法律领域,且交织着复杂的商业、政策和市场因素。

因此,“客户不仅满足于律师在单一法律领域内的专业解答,也不仅期望律师具备深厚的专业知识、精准的法律解读能力和丰富的实战经验,而越来越希望律师能够跨领域,提供全方位、综合性的法律服务,并且对个性化解决方案、高效沟通有更多的期待”。

因此,律师需要具备“专业能力+服务精神”,这样的“双重性”才构成了核心竞争力。“专业能力是基石,确保我们能够在复杂的法律环境中为客户提供准确、有效的法律支持。高质量的专业服务能力是律所行稳致远的关键。专业能力是律师的立身之本,它要求律师不仅有深厚的法学理论基础,还要对国际投资与贸易领域的最新法律法规、政策动态和市场趋势有敏锐的洞察力和把握能力。只有这样,律师才能准确判断客户的法律需求,提供精准的法律意见和解决方案。”

“服务精神则是律师与客户之间建立合作与信任的桥梁。它要求律师不仅要关注客户的法律需求,还要深入了解客户的商业目标和实际情况,以客户的利益为出发点,提供贴心、细致、高效的服务。律师要积极主动地与客户沟通,及时掌握案件进展,及时反馈案件信息,为客户提供全方位、全天候的法律支持。因此,律师要在不断提升专业能力的同时,注重培养服务精神,将两者紧密结合,形成独特的竞争优势,以更好地满足客户的多元化需求。”薛律师补充道。

正策律师事务所高级合伙人、债务重组与不良资产业务中心主任方智成律师也赞同以上观点,在他看来,专业能力在于“深入浅出”,服务精神则在于谨慎细致。

“专业能力不仅体现在案件中对法律的适用,包括诉讼思路、诉讼策略的选择等,也包括如何让法官、委托人理解以及认同我方主张的观点。而服务精神背后的逻辑在于律师要会沟通,包括沟通内容、沟通要点是否围绕委托人需求、沟通频率的把握等。二者是相辅相成的,律师靠专业能力获得客户信任,而服务精神的背后是足够扎实的法律知识和技能。”

因此,在方律师看来,“只有专业但不会服务的律师,客户粘性不高,因为律师跟客户的关系也是人与人的关系,遵循着基本的交际规律,不会表达、交流的律师亦会让委托人怀疑他/她的专业度;而只有服务却不专业的律师,能力经不起推敲,不能获得委托人的信任,更不能体现律师行业的价值。”

所以,专业能力和服务精神是相互补充、相互促进的状态。在实践中,律师需要平衡这两者,确保在提供专业法律服务的同时,也能给予客户应有的关怀和反馈。这种平衡有助于建立客户信任,提高法律服务的整体质量,达到更好的代理效果。

首选特质

谈及成为“客户首选”的律师特质,几位专家都纷纷指出了法律专业素养的重要性。

骆嘉昀律师认为,律师在为客户提供法律服务时具备以下特质尤为重要。“首先,是能够提供综合的解决方案,客户首选律师需要能够提供战略性指导和风险管理,超越单纯的法律条文分析;其次,是迅速响应的能力,在关键时刻能够为客户提供及时的法律支持。”

“第三,是深入理解需求,律师需要通过深入沟通,定制解决方案以满足客户需求;最后,是专业团队的构建,建立并管理一个能够高效处理案件的团队。”他说。

在薛为华律师看来,优质的法律服务应当具备三大要素:及时性、准确性、有效性。

“及时性是法律服务的重要属性。在快速变化的商业环境中,时间就是金钱,效率就是生命。律师要能够迅速响应客户的需求、提供高效快捷的应对方案,并及时提供法律意见和解决方案,帮助客户把握商机,避免损失。只有这样,客户才能充分信任律师,愿意将更多的法律事务交给律师处理。”

“其次,准确性是法律服务得以实现价值的基础。律师要对法律问题有精准的判断和深入的分析,确保为客户提供的法律意见和解决方案切实可行、符合法律法规要求。如果律师的判断出现失误或偏差,将会给客户带来不可估量的损失。因此,准确是律师专业能力的直接体现,也是客户选择律师的重要标准。”

“第三,解决方案的有效性是法律服务的关键所在。律师不仅要能够准确判断法律问题,还要能够为客户提供切实可行的解决方案,帮助客户实现利益最大化。这要求律师不仅要具备扎实的法律功底和丰富的实践经验,还要具备敏锐的市场洞察力和商业思维能力,能够为客户量身定制法律服务方案。”

随着经济和法律环境的变化,客户对律师的要求也在不断演化,具体到不良资产清收领域,方智成律师也有着深刻的感受。

“大环境不断变化,能直观感受到客户需要律师提供创新的解决方案,以应对回款难问题,传统、单一的法律服务方案已经不能帮助客户清收款项。通常,客户可能在一些基础回款途径已经失败的情况下才找到律师,这个时候,律师就要有能力为客户提供多角度、多维度的解决方案。与此同时,在清收过程中,客户对律师的沟通和协调能力要求更高,比如会要求提供团队成员、过往案例、过往经历等。”方律师指出。

此外,认真负责、耐心、周全等关键词,也经常出现在客户的评语之中。

薛为华律师认为,始终将客户的利益放在首位,才能够全力以赴为客户提供最优质的服务,因此,强烈的责任心和使命感令他受益匪浅,也是使他成为客户首选律师的特质之一。这也同样是他入行之初,带教律师对他的指导。

“此外,对法律工作的热爱和执着追求,促使我不断在这个领域持续学习、进步,我从复旦大学院毕业后一直保持对法律、以及律师事业的热情,十几年来无论市场环境如何变化,都未动摇过我对这份事业的执着追求。最后,是注重与客户的沟通和互动,始终以客户为中心,倾听客户的想法并为客户提供贴心、细致、高效的服务。”

对此,骆嘉昀律师也表示赞同,在过硬的基本功之外,律师需要保持创新和学习,只有紧跟市场和法律的最新发展,才能够融入创新思维;此外,律师也需要坚持长期主义,通过诚信和透明的特质,与客户建立长期信任关系。

愿景展望

面向未来,如何提升自我实力、如何构建强劲团队、如何为客户创造更大的价值,都是上榜律师思考和努力的方向。

从品牌特色出发,方智成律师将建立以专业为基本,提供有效推动、迅速回应的法律服务。

在他看来,“首先需要明确定位,我们的团队深耕于不良资产清收多年,要保持这一根基,并不断探索、研究新思路;其次,结合新的发展趋势持续学习,如今的案件可能涉及多个领域,需要多途径、多思维助推解决疑难案件;最后,吸纳更多志同道合的人才进入团队,打造一支专业、多领域的综合性团队,作到共进步、共收益”。

在团队建设层面,方律师希望能够明确团队的共同目标。“俗话说,‘道不同不相为谋’,除了需要确保团队成员具有互补的技能或领域,还要构建一致的认知,团队成员能够诚信互助、互相认同。当然,团队建设很考验律师的管理思维,合伙人也需要具备良好的领导和决策能力。”

薛为华律师则对于团队定位、技能培训、服务标准化和流程化、品牌建设与市场推广等方面,有着自身的见解和规划。

首先,明确团队定位和发展方向。薛律师将带领团队深入研究市场趋势和客户需求,明确团队在公司商事和涉外业务领域的专业定位和发展方向。通过精准定位,方能够集中资源、聚焦优势,为客户提供更加专业、高效、精准的法律服务。

In an era of economic uncertainty and evolving client demands, legal professionals face new challenges in delivering exceptional service, and they need both professional competency and a spirit of service to stay competitive. We delve into the preferred traits of these client-choice lawyers and their strategies for future growth in the legal services market.

 

This year, more than 1,944 in-house counsel and business professionals participated in the ALB survey to select their top 20 lawyers. In an era of economic uncertainty and evolving client demands, legal professionals face new challenges in delivering exceptional service, and they need both professional competency and a spirit of service to stay competitive. We delve into the preferred traits of these client-choice lawyers and their strategies for future growth in the legal services market.

The global economy is undoubtedly weak, and as a result, the legal services market is experiencing slow growth. Demand growth is limited while the number of practitioners keeps rising. This situation imposes stricter requirements on legal professionals while also challenging lawyers to innovate and provide more sophisticated, efficient, and cost-effective services.

According to Thomson Reuters Institute's 2024 State of the Corporate Law Department report, driven by basic business needs, law departments are looking to increase efficiency by improving how they perform work in-house and which outside counsel they choose to engage for which types of legal work. The report optimistically predicts that law departments largely expect to increase their spending on outside counsel in the coming year.

The 1,944 in-house counsel and business professionals who participated in this year's ALB survey have given objective and fair evaluations of their legal advisors from multiple perspectives. In addition to solid professional competency, clients have repeatedly mentioned the importance of the following capabilities: rigorous and dedicated work attitude, high service awareness, and deep understanding of client needs.

Consequently, developing both soft and hard skills has become crucial for legal professionals in this new era.

DUAL REQUIREMENTS

Lawyers have observed significant changes in clients' legal service demands as global economic integration deepens and the international trade environment grows increasingly complex.

To Stephen Luo, capital markets partner at Jingtian & Gongcheng, professional competency and service spirit have always been the two core requirements of the legal profession, and the combination of the two is essential to providing excellent legal services. He frankly states that as capital markets rapidly evolve, clients expect lawyers to not only interpret legal provisions but also provide comprehensive solutions and respond swiftly and accurately to their demands.

"Professional competency is the cornerstone of lawyers' work. We must constantly pursue more depth and breadth of professional knowledge to ensure that we can solve clients' legal challenges in an accurate and efficient manner. Second, service spirit is reflected in lawyers' profound understanding of client needs and our deep commitment to work. We need to be committed to listening to and understanding client needs as well as their business visions and specific challenges. Only by devoting ourselves 100 percent to each project can we ensure that clients have a professional and personalized service experience," says Luo.

He further points out that such dual requirements mean lawyers not only must have solid legal knowledge, but also need to be able to build trust with clients and show deep concern and firm commitment to their interests.

As an expert in cross-border services, Xue Weihua, partner of SGLA Law Firm, mentions that in complex and changing scenarios such as cross-border trade, investment and compliance, the problems clients face often involve multiple jurisdictions and legal fields and are intertwined with complex business, policy and market factors.

Therefore, Xue believes that "clients will not be satisfied with answers given by lawyers in a single legal area. Nor do they only expect lawyers to have deep professional knowledge, ability to accurately interpret the law and rich practical experience. Increasingly, clients want lawyers to be inter-disciplinary and provide all-round and comprehensive legal services. They also have higher expectations for personalized solutions and efficient communication".

As such, lawyers need to have both professional competency and service spirit, and this "duality" will become their core competitiveness. "Professional competency is the cornerstone, ensuring that we can provide clients with accurate and effective legal support in a complex legal environment. High-quality professional service capabilities are key to the long-term, stable development of firms. Professional competency is also the foundation of any lawyer. It requires lawyers to not only have a solid theoretical underpinning in law, but also have keen insight and firm grasp of the latest laws, regulations, policy dynamics and market trends in the field of international investment and trade. Only in this way can lawyers accurately assess the legal needs of clients and provide accurate legal opinions and solutions."

"Service spirit is the bridge for establishing cooperation and trust between lawyers and clients. It requires lawyers to not only pay attention to the legal needs of clients, but also gain an in-depth understanding of the business goals and realities of clients, and provide intimate, meticulous and efficient services by always acting in the best interest of clients. Lawyers should proactively communicate with clients to keep abreast of case progress, provide timely feedback on case information, and offer clients all-round and all-weather legal support. Therefore, while continuing to upgrade their professional competency, lawyers should focus on cultivating service spirit, closely combine the two to create their unique competitive advantages to better meet the diversified needs of clients," adds Xue.

Fang Zhicheng, senior partner of Joint-Win Partners and Director of its debt restructuring and non-performing assets business center, shares similar views. In his opinion, professional competency lies in the ability to "explain complicated matters in a simple way", while service spirit means being prudent and meticulous.

"Professional competency is not just about applying the law in a case, such as litigation ideas and the choice of litigation strategies. It is also about how to make judges and clients understand and agree with your points and arguments. The logic behind service spirit is that lawyers must be able to communicate, including what to communicate, whether the key points of communication are centered around the needs of clients, and how frequent to communicate. The two aspects complement each other. Lawyers rely on professional competency to gain client trust, while service spirit is backed by sufficiently solid legal knowledge and skills," says Fang.

Therefore, in Fang's opinion, "lawyers who are professionally competent but not good at service have low customer stickiness. This is because the lawyer-client relationship is also a relationship between people which follows the basic rules of interaction. A lawyer who does not speak or communicate well will also make clients doubt his/her professionalism. On the other hand, a lawyer who only provides services but is not professionally competent cannot withstand scrutiny, gain the trust of clients, and reflect the value of the legal profession".

Professional competency and service spirit are thus mutually complementary and reinforcing each other. In practice, lawyers need to balance the two, ensuring they can provide clients with due care and feedback while providing professional legal services. This balance helps build client trust, improve the overall quality of legal services, and achieve better results of representation and advisory.

PREFERRED TRAITS

Speaking of the traits of lawyers who have become "client choice", the experts point to the importance of legal professionalism.

Luo believes that it is particularly important for lawyers to have the following traits when providing legal services for clients. "First is the ability to offer comprehensive solutions. Client choice lawyers need to go beyond simple analysis of legal provisions to provide clients with strategic guidance and risk management. Second is the ability to respond quickly and provide clients with timely legal support at critical moments."

"Third is the ability to have an in-depth understanding of client needs. Lawyers need to customize solutions to meet client needs through in-depth communication. The last point is the building of a professional team, which is about establishing and managing a team that can handle cases efficiently."

According to Xue, high-quality legal services should have three elements: timeliness, accuracy, and effectiveness.

"Timeliness is an important part of legal services. In a rapidly changing business environment, time is money and efficiency is life. Lawyers must be able to respond swiftly to client needs, provide efficient and fast responses, and offer legal opinions and solutions in a timely manner to help clients seize business opportunities and avoid losses. Only in this way can clients fully trust lawyers and be willing to give more legal matters to lawyers."

"Second, accuracy is the foundation for legal services to realize their value. Lawyers must make accurate judgment and in-depth analysis of legal issues to ensure that the legal opinions and solutions provided to clients are feasible and in compliance with laws and regulations. Any errors or deviations made by lawyers in their judgment will cause immeasurable losses to clients. Therefore, accuracy is a direct reflection of a lawyer's professional competency and an important criterion for clients in choosing lawyers."

"Third, the effectiveness of solutions is key to legal services. Lawyers must be able to not only accurately assess legal issues, but also provide clients with practical solutions to maximize their interests. This requires lawyers to not only have solid legal skills and rich practical experience, but also keen market insight and business acumen, to be able to tailor legal service solutions for clients," adds Xue.

Changes in the economic and legal environment mean that clients' requirements for lawyers are also constantly evolving. Fang has witnessed such changes first-hand in the field of non-performing assets recovery.

"As the macro environment is constantly changing, I can directly sense that clients need lawyers to provide innovative solutions to tackle difficulties in collecting payments. Traditional, single legal service solutions can no longer help clients with collection. Usually, clients approach lawyers only after some basic ways of collection have already failed. In these circumstances, lawyers must be able to provide clients with multi-angle and multi-dimensional solutions. At the same time, during the recovery process, clients have higher requirements on lawyers' communication and coordination skills. For example, they may require a firm to provide information on team members, past cases, past experiences, etc," Fang points out.

In addition, keywords such as being responsible, patient and thorough also often appear in clients' comments.

In Xue's view, only by always putting clients' interests first can lawyers go all the way to provide clients with the best services. Therefore, having a strong sense of responsibility and mission has served him well and is also one of the traits that makes him a client choice. This is also the guidance given to him by his mentor when he first joined the profession.

"In addition, my love for and relentless pursuit of legal work have prompted me to continuously learn and improve in this field. After graduating from Fudan University Law School, I have always maintained my passion for law and the legal profession, and have never wavered in my pursuit of this career no matter how the market environment has changed over the past decade or so. Finally, I focus on communication and interaction with clients, and always aim to be client-centric, listen to clients' thoughts and provide them with intimate, meticulous and efficient services."

Luo concurs that on top of solid basic skills, lawyers need to keep innovating and learning. Only by keeping up with the latest developments in the market and law can they integrate innovative thinking in their work. Further, lawyers also need to adhere to long-termism and establish long-term trust with clients based on integrity and transparency.

OUTLOOK

Looking ahead, winning lawyers focus on upgrading their skills, building strong teams, and creating greater value for clients.

Building upon brand characteristics, Fang hopes to leverage solid professional competency to provide legal services in a swift manner that can effectively progress things forward.To him, "we first need to clarify our market positioning. Our team has been deeply involved in non-performing assets recovery for many years. We must maintain this foundation and continue to explore and study new ideas. Second, we must keep learning in tandem with new development trends. Nowadays, cases may involve multiple fields, and we need to employ multiple channels and multi-dimensional thinking to help solve difficult cases. Lastly, we need to attract more like-minded talents to join us and build a professional, multi-disciplinary and full-service team to achieve common progress and common benefits."

In terms of team building, Fang hopes to clarify the common goals of his team. "As the saying goes, 'people with different ideals cannot work together'. In addition to ensuring that team members have complementary skillsets or specializations, we must also build common understanding so that team members can help each other with integrity and identify with each other. Of course, team building is a huge test of lawyers' management skills, and therefore partners also need to have good leadership and decision-making capabilities," adds Fang.

Xue has his own thoughts and plans for team positioning, skills training, service standardization and process creation, as well as brand building and market promotion.

First is to clarify team positioning and development direction. Xue will lead his team to conduct in-depth research of market trends and client needs to clarify the team's professional positioning and development direction in corporate and commercial, as well as cross-border practice areas. With precise positioning, the team can pool together resources and amplify its advantages to provide clients with more professional, efficient and targeted legal services.

Second is to step up legal professional skills training and learning. He will organize team members to participate in regular professional training and exchanges to continuously improve their professional competency and comprehensive quality. At the same time, SGLA also advocates a learning culture and team spirit within the team, encouraging team members to learn from each other and support each other to progress together.

Third is to raise the standardization and process level of legal services. Xue plans to lead the team to sort out and optimize the legal services process and develop unified service standards and operating processes, so as to improve service efficiency and quality stability, and lower service costs and risks. He will also focus on the establishment of a client experience and service feedback mechanism to promptly collect and analyze client opinions and suggestions, and continuously improve and enhance service quality.

The final point is to focus on brand building and market promotion. Xue will make active use of various channels and platforms to publicize and promote the team's brand and service advantages, in an effort to raise the team's profile and reputation. He will also focus on establishing good cooperation and communication mechanisms with government departments, industry associations, business partners, etc. to create more business opportunities and resource support for the team.

Luo, on the other hand, is committed to further building up his own brand and his team through the following core strategies.

评选方法

In March, ALB launched the 2023 ALB China Client Choice survey. In-house counsel, company management, and third-party business consultants were invited to participate. Participants were asked to nominate their preferred lawyers for recognition, with nominated lawyers being required to be based in Mainland China and could specialize in any field of law. Responses were gathered from in-house counsels and business professionals representing various companies.

ALB于今年3月启动了2024年ALB China客户首选律师调查,邀请参与问卷的人士是公司法务人员、管理人员或第三方商业顾问。被提名的律师可以是任何业务领域或国籍,但必须常驻在中国大陆工作。在为期1个月的调查期中,收集到约1944份来自各公司法务及商务人士提供的调查反馈,每位参与者提名合作过的优秀律师,同时详细列举出了推荐理由。
