今年四月中旬到五月底,三家综合性国内律所——天达共和律师事务所、华商律师事务所、海润天睿律师事务所——先后在南京设立分所。

这样的“扎堆”并非一时之热:根据ALB的统计,从2017年起,包括京师、金杜、中伦、金诚同达、竞天公诚、兰台、安理、万商天勤等在内的律所都先后进驻南京。

南京是江苏省省会城市,具备深厚的科创实力,是长三角地区的核心城市之一。今年4月,伴随南京都市圈发展规划正式落地,南京及周边区域未来将迎来更多政策红利。律所又在这里看到了怎样的机会?

巡回法庭与法律产业园

对于律所来说,吸引他们来到南京的首要原因当属2016年最高人民法院在南京设立第三巡回法庭,其巡回区包括江苏省、上海市、浙江省、福建省和江西省。根据第三巡回法庭官网,该法庭主要处理由最高人民法院受理的在全国范围内重大、复杂的第一审行政案件,以及在全国有重大影响的第一审民商事案件等高端诉讼案。

“自从第三巡回法庭落子南京,东部沿海地区的诉讼业务更加密集地流向南京。” 天达共和律师事务所管理合伙人汪冬律师观察到。对于具备诉讼业务优势且具有全国布局策略的律所来说,跟随巡回法庭的脚步来到南京是十分明智的选择。

万商天勤律师事务所同样看到了巡回法庭带来的机遇。其南京办公室合伙人吴伟召律师告诉ALB,第三巡回法庭带来了许多高端诉讼业务,成为促使万商天勤迅速布局南京的一大推力。

数据同样表明了诉讼业务对于南京法律市场的重要性。根据南京律协不久前发布的《2020年南京市律师工作数据分析报告》,诉讼案件在南京律师业务结构中占有较大比重,其中民事、刑事案件分别占当地律师总创收的55.81%和16.89%。

南京吸引律所落地的第二个原因,则是当地对于法律服务行业的明确扶持。

吴伟召律师坦言:“万商天勤在南京设立办公室是基于全国战略布局的考量,但具体实施起来,需要一定的契机和政府政策扶持。”他特别提到了南京市建邺区司法局着力打造的法律服务产业园规划。

根据公开资料,吴伟召律师提到的南京河西·建邺法律服务产业园于2018年4月正式落成。第一批入驻的律所包括金杜、盈科,后续又迎来金诚同达、锦天城、协力等一众知名品牌。园区还组建了金融、知识产权、国际法律服务中心,以及法治文化研究中心,未来建成和北京朝阳、上海浦东并列的高创收法律服务区。

而这并非南京在法律产业园方面的首次尝试:早在2017年,南京就打造了江北新区法律服务园区。有趣的是,无论河西还是江北,都是南京未来重点发展的新城区,这似乎意味着在新城发展过程中,南京市政府都将法律服务作为了“支柱产业”和重点创收领域之一。

非诉业务增长机会多

上述两点优势外,律所也普遍看好金陵城的总体发展。

汪冬律师告诉ALB,随着南京自贸区、国家级江北新区建设加快,“南京的先进制造业、新兴金融科技产业日渐增多,非诉业务迅猛发展,激发出更多层级的法律服务需求”。

南京律师过去一年的创收数字印证了汪冬律师的观察。根据南京律协数据,2020年南京律师创收39.66亿元,同比增长12.86%,业务创收占江苏省创收总额的三成以上——虽然尚不及京沪,但和深广杭这类城市已不相伯仲。

此外,南京律师的非诉业务也在不断上涨,过去一年已占到总创收额的17.49%。

因此,汪冬律师告诉ALB,在争议解决之外,天达共和南京办公室还将建筑工程、金融与融资、涉外业务、破产重整作为未来的重点发展领域。

吴伟召律师对此也表示认同,他告诉ALB,南京优秀的金融非诉团队、建筑工程团队,都为万商天勤的未来发展打下基础。

不可小觑的 “外来户”

种种优惠政策吸引了众多新玩家涌入南京,也势必导致更加激烈的市场竞争。根据南京律协数据,截止2020年底,南京全市共有9203位律师,同比增长13.65%;律所486家,其中省外律所分支机构64家。

而根据江苏省法律服务机构法律服务人员信息公开平台数据显示,目前,南京规模最大的十家律所中,有七家是来自北京、上海的“外来户”,其律师人数均在百人以上。

目前,南京法律市场依旧面临着优势业务领域较为单一的问题,新玩家参与切蛋糕,究竟会让蛋糕越来越大,还是会把蓝海变红海,还要拭目以待。律所无疑将在这一市场采取不同策略,争取尽快打出差异化优势。

对于天达共和来说,南京办公室成功的要义在于做好长三角不同办公室间的搭配。“天达共和上海、武汉、杭州、南京办公室将会组建‘长江经济带办公室’,” 汪冬律师向ALB透露,“给予各地办公室一定的自由度,通过搭建新的制度框架,释放生产力。”

万商天勤则准备充分挖掘城市优势——即南京强大的学术和人才力量。“我们会重点挖掘东南大学法学院、南京大学法学院、南京师范大学法学院、南京审计大学、南京工业大学、河海大学的优秀毕业生。”吴伟召律师说,不仅如此,南京办公室还在成立伊始,就和东南大学法学院成立了网络犯罪研究中心,深入研究类案。

“通过积极展开与高校之间的文化建设,引进优秀人才,我们期待在三到五年内发展为百人规模大所,超越竞争对手。”吴伟召律师说。

 

Why Nanjing has recently become a magnet for Chinese law firms

In the six-week period between the middle of April and the end of May, three large Chinese law firms, East & Concord, China Commercial Law Firm and Hai Run Law Firm, announced or established new branch offices in the city of Nanjing. The three are part of a growing trend; since 2017, firms like Jingsh Law Firm, King & Wood Mallesons, Zhong Lun Law Firm, Jincheng Tongda & Neal, Jingtian & Gongcheng, Lantai Partners, Anli Partners and V&T have planted their flag in the “southern capital.” 

So why is Nanjing, referred to as the “pearl of the Yangtze River Delta,” so popular of late? Lawyers attribute it to the  city’s geographical advantages and legal market opportunities. “The Yangtze River Delta is one of the regions with the most active economy, the highest degree of openness and the strongest innovation ability in China,” says Wang Dong, the managing partner of East & Concord. “It is an important intersection of the ‘Belt and Road’ and the Yangtze River Economic Belt. Nanjing, being the core city of the Yangtze River Delta and the Yangtze River Economic Belt, has developed rapidly in recent years. With the accelerated construction of the Nanjing Free Trade Zone, the national-level Jiangbei New Area and the approval of the first national metropolitan area development plan, Nanjing’s future development is even more promising.”

Wang adds that with Nanjing’s proximity to Shanghai and Hangzhou, and location in the downstream of the Yangtze River, an office in the capital of Jiangsu Province provides a vital piece in the jigsaw puzzle that is East & Concord’s domestic expansion. With the firm also having an office in Wuhan, located upstream of the Yangtze completes the legal services offering along the waterway. 

Wu Weizhao, partner at V&T’s Nanjing office, which was set up in October 2020, adds that there are other in Nanjing’s legal market. “The Supreme Court established the Third Circuit Court in Nanjing, which is a good opportunity for our high-end litigation business,” says Wu. “Also, the planning of the legal service industrial park that the Bureau of Justice of Jianye District in Nanjing, as well as the acquaintance we made with local legal professionals in the fields of finance, construction and criminal defence are all among the elements driving us to Nanjing.” 

V&T has been actively recruiting locally since opening the office. According to Wu, instead of focusing on individual partners, V&T’s Nanjing office has been looking for local teams for hire. It is also working with local universities to look for young graduates with potential, who are trained and cultivated with resources allocated from V&T’s offices nationwide.

East & Concord is also sharing resources between its headquarter and Nanjing branch, as guided by its integrated management philosophy. “Our integrated management allows all the offices to cooperate and share resources in the most efficient way. In the future, the Nanjing office’s resource will be extended to our national legal network, just like how all the other offices are supporting Nanjing,” Wang says.
