今年上榜ALB China十五佳律师新星榜单的律师平均年龄为37.7岁,平均从业年限约为13年,他们均凭借着不凡的成绩,在各自的专业领域散发着光芒。他们有着怎样的成长路径与未来目标?哪些特质让年轻的他们获得了市场的认可?又是怎样的素养使他们得到了客户的青睐?ALB邀请部分上榜律师分享了他们在执业道路上的成长之路,以及执业心得与体会。
幸运、热爱与坚持
毕业来到北京后,己任律师事务所合伙人韩进文律师的第一份执业就在知识产权领域。“非常幸运的是,我的带教老师是一位非常专业且严格的律师,在他的指导下我收获良多。更幸运的是,工作之后,我发现自己真的非常热爱知识产权这个领域。也正因如此才能够在这个领域工作至今。”
在韩律师看来,自己的成长路径其实极为“普通”:从律师助理到律师,再到资深律师、合伙人,其实都在脚踏实地,一步一个台阶向上攀爬。
作为知识产权律师,他扎实专业、精益求精,韩律师坦言支撑自身职业发展的正是对所执业领域的热情,以及清晰的自我目标设定。“律师职业本质上是服务行业,需要数十年如一日用心工作,同时还需要不断学习新法律、新案例、新知识。如果没有热情,工作将无法收获那么多快乐。
“与此同时,目标和热情也是相辅相成的,目标带来热情,热情则支持你抵达目标。但这里的目标需要‘大于自己’,只集中在自己身上的目标是没有办法长期提供热情的。”他说。
此外,韩律师热爱和坚持知识产权领域的另一个原因则是他“非常享受看到并伴随客户的成长和行业的发展”。
在韩律师看来,无论是技术类企业还是品牌类企业,知识产权对每家企业来说都是非常重要的资产,也是企业健康可持续发展的保障。因此,为企业量身定制知识产权保护策略,见证得到充分保护的知识产权助力企业快速发展,这为韩律师带了极大的职业成就感。同时,伴随着中国知识产权立法和实践的快速发展,作为知识产权领域的一分子,感受并参与到知识产权的时代发展当中,也是一件非常令人满足的事情。
专业立身、进取担当
中伦律师事务所合伙人李瑞律师从北京大学毕业后就加入了目前所在的团队,一路完成了从实习生到主办律师,再升任合伙人的成长之路。期间李律师也曾赴美学习一年,并考取了美国纽约州律师资格。
李律师告诉ALB,入行之初,她主要专注于外商直接投资、跨境并购(入境)业务。在该领域亲自操刀了多项大型、高端、疑难、前沿的中外合资及跨境并购项目,其中以北京环球影城度假区合资项目最具代表性。作为环球度假区在中国的首次落地,该项目投资额超过500亿人民币,合作覆盖合资、知识产权、房地产和建设工程、酒店及商务等各方面,涉及到诸多复杂和疑难问题,历时三年才最终完成主要交易文本谈判。
伴随着大环境发展以及自身兴趣变化,李律师也不断拓展自身执业领域,现在主要以跨境并购及合规工作为主。尤其是在中国数字经济飞速发展的背景下,数据合规成为诸多行业发展的题中之义,李律师也参与了多项前沿、复杂、疑难的数据合规工作,其中最具代表性的是亿咖通科技与COVA以De-SPAC方式合并上市项目。在相关规则尚未正式出台的情况下,李律师给出多项前瞻性建议,妥善处理不确定风险,最终助力项目成功过关。
在工作中,李律师一直坚持着专业立身的基本原则。在她看来,律师首先要有过硬的专业能力作为基石。“‘专业度’并非一蹴而就,而需要持久保持,除了良好的基础和勤勉的习惯,还需要律师始终保持在业务第一线,自身及带领团队坚持学习,形成良好且可持续的知识管理系统,成为所执业领域的‘专家’。要做到专业,还需要懂得取舍,聚焦一到两个赛道,对于自身不专精的领域要及时为客户对接其他专业团队,一切以为客户提供专业服务为导向。”
此外,在李律师看来,进取有担当、具备问题解决思维对律师也至关重要。特别是近年来,跨境商事及数据合规领域的立法和执法情况发展迅速,法律需求越来越前沿、综合,律师工作中遇到的“疑难杂症”也越来越多。
“律师不能只会处理传统和标准类型的法律问题,也要懂得如何处理和协助客户提出的‘非标’类需求。对此,在守住专业底线的同时,律师往往需要准确掌握相关领域的底层逻辑、立法/执法/行业动态的基础上,抽丝剥茧,举一反三,在不确定性中寻找确定性,在把握好执业底线的同时大胆尝试可能的路径。”李律师说。
寻找平衡之道
安杰世泽律师事务所合伙人梁冰律师的职业生涯起步于保险行业:硕士毕业后,她进入一家保险公司总部,开始了合规管理工作。梁律师回忆道:“保险是讲究实干的行业,在我还没有深入接触保险法律合规时,我已经通过轮岗制度,了解了公司各个基础岗位的工作职责和挑战,对保险行业的运作和业务有了全面的理解,从而帮助我建立了法律合规应当助力业务发展的初心。”
此后的五年,梁律师曾协助公司进行过创新业务论证,其中UBI车险的合法合规、无人驾驶汽车的法律责任等迄今仍属于业界热门课题。此外,监管现场检查、合规报告起草等一系列工作也让她对大型保险公司的运作以及金融监管的实操有了更为生动的经验。不过,也正是这段保险行业的经历,让梁律师越发意识到自己对法律垂直领域钻研的热情,继而转型成为了一名保险法专业律师。
30 岁转行做律师,34 岁成为律所合伙人,在梁律师看来,法律合规与商业利益之间存在着一个微妙的平衡点,寻找到这个平衡点既是对法律法规的维护,也是对客户利益的保护,更是作为一名律师最大的成就感和乐趣所在。
作为精通保险负债端、公司治理端和投资端全流程的保险法律师,执业以来,梁律师担任了近 30 家金融机构或者互联网头部企业的常法顾问,累计服务保险机构、资产管理公司、央国企60 家余家,同时也负责主办过许多保险行业内最为前沿且复杂的项目,单个项目投资金额不乏百亿级别,平均投资金额达数十亿。
在梁律师看来,她的角色不仅仅是法律顾问,更是业务合作伙伴和产品设计师。“面对复杂多变的业务模式和产品形态,以及法律法规的制约和监管机构的标准,律师需要深入了解企业业务和产品的需求和特点,从而更好地为客户提供全方位的法律支持和风险管理建议。”她总结道。
克服挑战、坚定信念
万慧达知识产权合伙人王宇明律师自2009年便开起了律师事务所执业,最初主要从事民商事诉讼及企业法律顾问工作,随着时间的推移,自2014年开始,他从商标授确权行政诉讼和商标侵权民事诉讼做起,随后拓展到专利侵权诉讼等领域,走上了专注于知识产权领域诉讼和相关法律服务的职业道路。
王律师告诉ALB:“尽管没有技术领域背景,但我努力克服了文科生的畏难心理,与专利代理人密切配合,促成了诸多专利案件的顺利解决。得益于客户的信赖和万慧达平台的支持,近些年来,我先后代理了一系列在商标和专利领域有一定影响力的案件,在诉讼策略和技巧上也实现了成熟与精进。”
执业中,最令王律师记忆犹新的是代理“新华字典”未注册驰名商标案的经历。 “从2015年开始,历经3年,我们最终成功说服法院认定‘新华字典’为未注册驰名商标,并突破了未注册驰名商标在商标侵权诉讼中不予判赔的先例,成功获赔 327 万元。”
该案随后入选了2017年中国法院10大知识产权案件、2017年度北京法院知识产权司法保护十大案例、中华商标协会优秀商标代理案件,并位列中华全国律师协会知识产权专业委员会十佳知识产权案例榜首。该案是王律师首次主办较为疑难复杂、证据体量庞大的案件,也对他坚定深耕知识产权法领域的信念产生极为重要的影响。
服务之道
作为“80后”,律师新星面临着不同的时代背景和客户需求,因此在服务客户方面也与前辈有着不尽相同的方法论,积累了属于自己世代的工作心得。
对此,中伦的李瑞律师分享道:“要处理好疑难复杂的法律问题,律师需要同时具备专家、问题解决者、商人、团队管理者等多种角色的能力和长处,缺一不可。”服务客户时,她重点关注的层面包括三个:尽职尽责、风险管控、商业思维。
首先,李律师在团队内部经常强调的“take ownership……只有尽职尽责,把客户的事情当成自己的事情来做,才能做到甚至比客户想得更超前、更周严”。其次,律师也要具备风险意识,她指出,这与服务客户并不矛盾,相反,准确把握专业底线和风险红线,结合良好的沟通,才能够保护客户及自身的利益。因此在服务客户时,她时常对项目面临的风险以及对自身可能存在的执业风险做足预期,并对客户做出充分的预警和提示,严守合规红线。
最后,李律师也深谙商业思维的重要性。“一方面,律师需要懂行业、懂企业,‘把自己装到客户的鞋子里’,确保工作成果能够充分为客户赋能;另一方面,从更宏观的维度来看,律师能够及时感知甚至预判经济的流动和变化,提前做好准备,及时响应甚至引领客户的需求。好律师也在一定程度上具备商人的嗅觉。”
安杰世泽的梁冰律师则强调在执业过程中将法律合规与商业利益相结合。“首先,律师需要从客户需求出发,理解其商业目标和运营模式。”梁律师说,“商业运营往往有常规路径,但创新的思路则来自于链接起点和目标的最短路径。作为致力于发展业务的律师,我努力发现并支持客户实现商业目的的最短路径。此外更值得关注的是,一项业务往往包含着多项需求,如何在实现各项诉求的基础上搭建最短可行路径,也体现了律师的功底和经验。”
其次,律师需要认识到法律与合规是动态发展的,创新和立法则是相互成就的。“在实践中,律师经常面临着法律合规和商业利益之间的矛盾。有时为了保护客户利益,律师的工作仿佛是要寻找法律漏洞或灰色地带。但事实上,如何处理这一情况正是商业思维和法律专业素养结合的最大体现:杰出的律师如果在穷尽现行有效法律法规、执法或者司法实操之后,仍然没有支持或者否定的依据,则应该在监管或者司法趋势、法益的保护之下,基于监管或者法律原则给出切实可行的建议。”梁律师说。
在知识产权领域,己任的韩进文律师认为助力客户的基础依旧是专业素养,否则一定会被市场淘汰。因此“律师需要不断学习、夯实基础、磨炼技能,才有可能具有自身优势,并获得客户青睐”。
另外他还表示,为客户保驾护航需要具备“partnership”的觉悟。“律师要成为客户的同伴,才能够进一步了解客户的行业、需求,从而站在客户的角度思考问题,从而最终拿出满足同伴、成就同伴的方案。同时,伴随着团队工作的不断增加,团队成员也需要把彼此当成‘同伴’,明确职责分工,方能成为一个卓越的团队。”
据万慧达的王宇明律师观察,过去一年,客户在知识产权运用、许可及相关合同审查方面的需求逐渐攀升,“知识产权作为一项企业资产,主要是围绕商业需求服务。如何提升自身知识产权的商业价值是客户最为关心的问题;而诉讼只是解决外部冲突的诸多手段之一,通常并不是客户的首选”,王律师就此分析道。
在此方面,律师可以通过开展培训、制定合同模板、采取切实有效的知识产权运用等措施来助力企业。“若能够为客户就如何更好地运用知识产权、防范知识产权风险、提升知识产权保护水平提供建议,并得到客户采纳,就会产生十分积极的效果。“王律师说。
下一步计划
展望未来的职业愿景与规划,梁冰律师坦言自己将继续朝着“成为最好的保险法律师“的目标努力。“保险行业的发展和挑战一直在激发更多的法律服务需求,保险法律服务也将随着行业的发展变化而迭代升级。接下来,我将不断提升专业能力和行业影响力,进一步深耕保险业务。”
“同时,我也将更注重团队管理,给律师以行业经验、给行业人才以执业技能,从而提升团队势能,以团队作战的方式进一步提高法律实践的质效。”梁律师说。
在李瑞律师看来,律师职业能让人保持好奇心,保持专业精进和探索,保持对社会的观察、思考、投入和贡献。而面对不确定性带来的挑战,她直言:“越是当前这样的时代,越需要优秀的律师积极投身于时代浪潮,帮助有远见者明晰方向,践行战略,抵御风险,纾危化困。”
谈及团队发展,李律师表示:“在团队建设中尤其需要贯彻细节落实问题,好的法律服务不仅需要律师本人具备优秀的素养,还需要有高效而成熟的团队支持完成,组建和培育团队是每一个‘新手合伙人’的必修课。现在除了客户工作,我有不少精力用于知识研究和分享,同时也开始在工作之余与政法院校合作,指导和培养年轻法律人,未来也希望在立法、研究、分享、授课方面投入更多精力。”
韩进文律师对职业发展的未来期许是成为知识产权领域的顶尖律师,成就客户和身边的人,让世界称赞中国的知识产权保护水平。此外,作为西南政法大学的毕业生,未来借助己任的成都办公室,他也希望能够助力带动川渝地区知识产权保护,匹配当地经济的快速发展,并为律所发展做出更多的贡献。
王宇明律师在将来则会继续不遗余力地为客户提供全面、优质的知识产权法律服务。他告诉ALB,律师在捍卫客户智力成果的同时也需要打造自身品牌:“我们要求团队成员时刻保持热情,同时懂得协作,勇敢担当;技术上要有自己的特色,但基本功必须扎实;创新始终被提倡,但经验的积累和分享同样重要。我们期望万慧达的律师、整体的平台以及我们所服务的客户能共同发展,共同进步。”

Kevin Han, a partner at GEN Law Firm, embarked on his career in intellectual property law in Beijing immediately after graduating. Reflecting on his early days, he acknowledges the fortune of having a professional and stringent supervisor who provided invaluable guidance. Through this mentorship, he discovered his passion for IP law, a field in which he has thrived ever since.
Han describes his career trajectory as "ordinary," progressing steadily from assistant to lawyer, senior lawyer, and finally, partner. Each step has been meticulously built upon a solid foundation of expertise and an unwavering commitment to excellence.
Han has demonstrated a profound dedication to his craft as an IP lawyer. He acknowledges that the driving force behind his career is a combination of passion and clear goals. He recognises that lawyers fundamentally serve as providers of legal services, necessitating perseverance and a continuous pursuit of knowledge in the form of new laws, cases, and legal principles. With enthusiasm, true joy in the work can be attained.
Han firmly believes that goals and enthusiasm are intertwined. Goals fuel enthusiasm, propelling individuals towards their aspirations. However, he emphasises the importance of setting goals beyond oneself, as self-centred goals fail to sustain long-term enthusiasm. According to Han, a broader perspective encompassing the growth of clients and the industry is key to fostering enduring passion.
One of the reasons Han remains committed to IP law is his delight in witnessing and contributing to the growth of his clients and the industry as a whole. He recognises the crucial role that intellectual property plays in the success and sustainability of companies, regardless of whether they are technology-driven or brand-oriented. By tailoring IP protection strategies that ensure comprehensive safeguarding of intellectual property rights, Han finds immense fulfilment in supporting enterprises as they thrive. Furthermore, he derives satisfaction from actively participating in and witnessing the rapid development of IP legislation and practice in China.
Han's career is a testament to the power of passion, unwavering dedication, and a genuine commitment to the growth of both clients and the industry in intellectual property law.
PROFESSIONALISM AND COMMITMENT
Li Rui, a partner at Zhong Lun Law Firm, joined the firm after graduating from Peking University and has since achieved remarkable growth, progressing from a trainee to a lead counsel and ultimately an equity partner. She further expanded her legal expertise by completing a one-year training program in the United States, leading to her admission to the New York State Bar.
Initially focusing on foreign direct investment and cross-border M&A (inbound), Li handled numerous large-scale, high-profile, and intricate joint venture and cross-border M&A projects. One notable project she worked on was the Universal Beijing Resort, the first Universal Studios theme park in China. This multifaceted endeavour involved investments exceeding RMB 50 billion and encompassed various legal aspects such as joint ventures, intellectual property, real estate and construction engineering, hotels, and business operations. Due to the complexity of the issues involved, negotiations for the main transaction documents spanned three years.
As both the legal landscape and Li's personal interests evolved, she expanded her practice areas, particularly emphasising cross-border M&A and compliance. The rapid growth of China's digital economy has made data compliance a critical factor in many industries. Consequently, Li actively participated in cutting-edge and complex data compliance projects, including the De-SPAC merger and listing transactions between ECARX and COVA. In cases where relevant rules still needed to be established, Li's forward-looking proposals were pivotal in ensuring project success while mitigating uncertain risks.
Throughout her career, Li has consistently upheld the basic principle of professionalism. She firmly believes that solid expertise serves as the cornerstone for lawyers. However, she emphasises that professionalism is not attained overnight. It requires a strong foundation, diligence, and a continuous commitment to staying at the forefront of legal developments. Li advocates for building a robust and sustainable knowledge management system, both individually and within her team, by fostering a culture of continuous learning. This enables them to become experts in their chosen fields while seamlessly referring clients outside their specialisation to the appropriate teams capable of providing specialised services.
Li also emphasises the significance of an enterprising, responsible, and problem-solving mindset. In recent years, cross-border transactions and data compliance have witnessed rapid legislative and enforcement developments, presenting lawyers with increasingly complex challenges. Li believes lawyers must go beyond dealing with traditional and standardised legal issues. A BALANCED WAY
Liang Bing, a partner at AnJie Broad Law Firm, began her career in the insurance industry after completing her master's degree. She joined an insurance company and focused on compliance management at its headquarters. Liang recognised the value of practical experience in the insurance sector and embraced the opportunity to understand the responsibilities and challenges of various roles within the industry. This firsthand exposure allowed her to understand the insurance landscape comprehensively, which fueled her desire to drive business development through legal compliance.
Over the next five years, Liang played a key role in spearheading innovative projects related to the legality of usage-based insurance (UBI) and the legal liability associated with driverless cars. These initiatives remain highly relevant and topical within the industry. In addition, Liang engaged in activities such as on-site regulatory inspections and drafting compliance reports, providing her with a vivid insight into the operations of large insurance companies and practical financial regulations. Through these experiences, Liang's passion for legal services grew, leading her to transition into specialising in insurance law as a lawyer.
Achieving the status of a lawyer at 30 and becoming a partner at 34, Liang believes in striking a delicate balance between legal compliance and business interests. This balance entails adhering to laws and regulations and safeguarding clients' interests, which she finds to be the greatest source of accomplishment and satisfaction as a lawyer.
As an insurance law specialist well-versed in insurance liabilities, corporate governance, and investments, Liang has served as a regular legal advisor to nearly 30 financial institutions and Internet giants. She has also provided counsel to over 60 insurance institutions, asset management companies, and central state-owned enterprises.
Liang has overseen numerous cutting-edge and complex projects within the insurance industry, with average investment amounts ranging from several billion to tens of billions. Her extensive experience positions her as more than just a legal advisor; she sees herself as a business partner and product designer. Recognising the intricacies and evolving nature of business models and product forms, Liang believes that lawyers must comprehend the needs and characteristics of corporate operations and products. This understanding enables them to provide clients with comprehensive legal support and valuable risk management advice.
Liang's career showcases her expertise in insurance law and her ability to navigate complex projects within the industry. Her role extends beyond legal advisory to that of a trusted business partner and product designer, as she combines her legal insight with a deep understanding of her clients' specific business needs.
OVERCOMING CHALLENGES WITH FIRM CONVICTION
Wang Yuming, a partner at Wanhuida Intellectual Property, commenced his legal career in 2009, specialising in civil and commercial litigation and corporate counselling. Since 2014, he has steadily expanded his areas of expertise, progressing from administrative litigation related to trademark authorisation and determination, and civil litigation regarding trademark infringement, to encompass patent infringement litigation. Wang has carved a career path centred on IP litigation and associated legal services.
Despite not having a technical background, Wang has overcome any apprehension regarding challenges and collaborated closely with patent lawyers to successfully handle numerous cases. He attributes his growth and improved litigation strategies and skills to the support of his clients and Wanhuida. Wang vividly recalls a significant unregistered well-known trademark litigation case involving Xinhua Dictionary. The process spanned three years, commencing in 2015, during which Wang and his team convinced the court that "Xinhua Dictionary" qualified as an unregistered well-known trademark. This landmark decision departed from the precedent of denying compensation in infringement litigation for unregistered well-known trademarks, ultimately securing RMB3.27 million for the client.
The Xinhua Dictionary case garnered recognition as one of the top 10 IP cases in Chinese courts in 2017 and ranked among the top 10 judicial IP protection cases in Beijing courts in the same year. Furthermore, the China Trademark Association deemed it an excellent trademark agency case. It topped the list of the top 10 IP cases compiled by the Intellectual Property Committee of the All China Lawyers Association. This complex and challenging case, characterised by substantial evidence, significantly influenced Wang's unwavering commitment to exploring the depths of IP law.
Wang Yuming's career trajectory showcases his evolution as an IP litigator and his ability to tackle intricate cases. Despite lacking a technical background, his dedication, collaboration with colleagues, and support from clients and his firm have propelled him to handle influential trademark and patent cases. The success of the Xinhua Dictionary litigation, in particular, has solidified his belief in the importance of delving into IP law and honing his expertise in this field.
THE WAY OF SERVICE
Faced with evolving environments and client needs, these young lawyers have amassed unique methodologies and experience in serving their clients.
Li emphasises the importance of combining the skills of experts, problem solvers, people in business, and team managers to address complex legal issues. Her top priorities in client service are due diligence, risk control, and a business mindset.
Firstly, Li stresses the significance of taking ownership of the client's business. She believes that by treating the client's business as their own, the team can think ahead and provide thorough solutions. Secondly, lawyers should be risk-aware. Li understands that this is consistent with client service, as an accurate understanding of the professional bottom line and effective risk control, coupled with clear communication, can protect the interests of both clients and legal professionals. Li always anticipates potential risks in projects and practices, providing appropriate warnings and guidance to clients to ensure compliance.
Additionally, Li underscores the importance of a business mindset. Lawyers need to understand their clients' business and industry, enabling them to empower their clients fully. Moreover, from a broader perspective, lawyers should be able to perceive or even predict economic trends and respond proactively. A skilled lawyer possesses business acumen and can go beyond expectations.
Liang values the combination of legal compliance and business interests in her practice. She believes lawyers should understand their clients' business goals and models to support them effectively. While business operations often follow a specific path, innovative ideas can emerge from finding the shortest way that connects the starting point to the goal. As a lawyer dedicated to business growth, Liang works diligently to help clients discover the most efficient path while meeting all their needs.
Furthermore, lawyers need to recognise that laws and compliance are dynamic, while innovation and legislation are complementary. Liang understands that lawyers may encounter conflicts between legal compliance and business interests. Instead of solely seeking legal loopholes, a skilled lawyer combines business mindset and legal expertise to provide practical advice based on regulatory principles when necessary.
Han believes professional competence is the foundation for client support, and unprofessional lawyers eventually fade from the market. He emphasises the importance of continuous learning to consolidate knowledge and improve skills, enabling lawyers to gain clients' favour with their strengths.
Han also highlights the concept of "partnership" when serving clients. Lawyers should view clients as companions, understanding their businesses and need from their perspective to develop plans that satisfy and empower them.
