2019年10月1日，《关于内地与香港特别行政区法院就仲裁程序相互协助保全的安排》（下文简称《安排》）正式生效，希德律师事务所香港办公室于《安排》生效当日，协助了内地香港间首例仲裁保全案例。

希德所代理的仲裁申诉人与被诉人因租船合同陷入纠纷，双方协商和解后，被诉人未能按时支付和解费用，根据协议，申诉人向香港国际仲裁中心申请仲裁，随后根据新生效的《安排》，向被诉人财产所在地上海的上海海事法院申请了临时财产保全措施。10月8日，上海海事法院随即发出了相关保全命令。

这是新《安排》生效后的第一案。根据《安排》，未来内地和香港仲裁程序当事人，都可向彼此法院申请保全。早在2002年，内地与香港间就通过《最高人民法院关于内地与香港特别行政区相互执行仲裁裁决的安排》相互协助仲裁执行，新《安排》则进一步打通了两地间仲裁执行与保全的通道。值得一提的是，香港目前也是中国内地以外，第一个也是唯一一个内地法院可以批予保全的司法管辖区。

希德此次项目牵头人为法务总监刘洋，团队成员包括律师Maggie Lee。申诉人在上海海事法院的代表律师为协力律师事务所合伙人蓝鹭安。

Hill Dickinson obtain landmark Mainland-Hong Kong arbitration order

Hill Dickinson has become the first law firm in Hong Kong to successfully obtain an order from a mainland Chinese court for interim measures in aid of an arbitration administered by the Hong Kong International Arbitration Centre.

The mainland-Hong Kong arrangement concerning mutual assistance in interim measures concerning arbitration proceedings came into effect on Oct. 1. On the same day, Hill Dickinson Hong Kong, on behalf of the claimant, filed an application with the HKIAC to pass on the claimant’s application for property preservation to the Shanghai Maritime Court, and the court granted a property preservation order against the respondent on Oct. 8.

Hong Kong is the first and only jurisdiction granted interim measure assistance by mainland courts.

Hill Dickinson’s team comprised legal director Edward Liu and associate Maggie Lee. The claimant was represented in the Shanghai Maritime Court by partner Anna Lan of Co-effort Law Firm.
